These Terms of Use govern your use of the TinniCalm: Tinnitus Relief & Sound Therapy mobile application (hereby referred to as "Application" or "TinniCalm") developed by IMAD EL KHAFI (hereby referred to as "Service Provider," "we," "us," or "our").

By downloading, installing, accessing, or using TinniCalm, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Application.

• AI responses are generated automatically and should not replace professional medical advice
• We strive for accuracy but cannot guarantee the completeness or reliability of all AI-generated content
• Token usage may be limited for free users to ensure fair access
• AI interactions may be analyzed to improve service quality (in aggregated, anonymized form)

TinniCalm may integrate with or display content from third-party services. These services have their own terms and conditions:

• Google AdMob (advertising)
• Firebase (analytics and backend services)
• Apple HealthKit (health data integration)
• OpenAI (AI assistant functionality)
• Apple App Store
• Google Play Store

We do not control and assume no responsibility for third-party content, privacy policies, or practices. You acknowledge that we shall not be responsible for any damage or loss caused by your use of third-party services.

TinniCalm, including all content, features, audio assets, and functionality, is owned by the Service Provider and is protected by international copyright, trademark, patent, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use TinniCalm solely for personal purposes. Any feedback, suggestions, or ideas you provide regarding TinniCalm may be used by us without obligation or compensation to you.

To improve TinniCalm and provide relevant content:

• Free users may see personalized advertisements
• Premium subscribers enjoy an ad-free experience
• You can opt out of personalized advertising in your device settings

⚠️ Limitation of Liability

To the maximum extent permitted by applicable law, the Service Provider shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages relating to your access to, use of, or inability to access TinniCalm
• Any reliance on information provided through the Application
• Technical failures, interruptions, or inaccuracies

Our total liability to you for all damages shall not exceed the amount you paid for TinniCalm Premium in the past 12 months, or fifty dollars ($50) if you haven't made any purchases.

TinniCalm requires:

• A compatible iOS or Android device
• Internet connection for full functionality
• Sufficient storage space for audio content
• Microphone access for pitch finding features (optional)
• Notification permissions for reminders (optional)

We may provide updates to improve functionality, security, and user experience. While not mandatory, updates are strongly recommended for optimal performance and security.

TinniCalm is provided "as is" and "as available" without warranties of any kind. We do not warrant that:

• The Application will function uninterrupted or error-free
• All features will be available at all times
• The Application is free of viruses or harmful components
• Results will meet your expectations or provide medical benefits
• Third-party integrations will remain available

🚫 Termination

We may terminate or suspend your access to TinniCalm immediately, with or without notice, for any reason including:

• Violation of these Terms
• Fraudulent or abusive behavior
• Technical or security reasons
• Legal requirements

Upon termination, your right to use TinniCalm will cease immediately. You may terminate your use by simply deleting the Application from your device.

🌍 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Morocco, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Morocco.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
