1. Acceptance of Terms

By accessing or using AquariumPulse ("the App"), you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

These terms constitute a legally binding agreement between you and IMAD EL KHAFI ("we," "us," or "our").

2. License to Use

Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use AquariumPulse on your iOS devices for personal, non-commercial purposes in accordance with these terms.

Restrictions

You agree NOT to:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App's functionality
• Use the App in any way that could damage, disable, or impair our systems

3. User Responsibilities

Account and Data

You are responsible for:

• Maintaining the security of your device and iCloud account
• All activity that occurs through your use of the App
• The accuracy and appropriateness of data you enter into the App
• Creating backups of your data as needed

Proper Use

You agree to use AquariumPulse only for lawful purposes and in accordance with these terms. You will not use the App in any manner that:

• Violates any applicable law or regulation
• Infringes upon the rights of others
• Is harmful, fraudulent, deceptive, or offensive
• Involves the transmission of viruses or malicious code

4. Aquarium Care Disclaimer

The App provides:

• Tools for tracking water parameters, livestock, and maintenance schedules
• General insights based on your recorded data
• Reminders for routine maintenance tasks

The App does NOT provide:

• Professional veterinary or aquatic care advice
• Diagnosis or treatment of fish diseases
• Guarantees about aquarium health or livestock survival
• Scientific validation of water parameter recommendations

You are solely responsible for the care and wellbeing of your aquatic animals. Always consult with qualified aquarium professionals, veterinarians, or experienced aquarists for specific advice about your livestock.

5. No Warranties

AquariumPulse is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of content
• Warranties that defects will be corrected

We do not warrant that:

• The App will meet your specific requirements
• Data stored in the App will never be lost or corrupted
• iCloud sync will always function perfectly
• Following App recommendations will guarantee healthy aquariums

6. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of profits, revenue, data, or use
• We shall not be liable for any harm or loss to your aquatic livestock
• Our total liability shall not exceed the amount you paid for the App (if any)

7. Data and Privacy

Your use of AquariumPulse is also governed by our Privacy Policy. Key points:

• All your aquarium data stays on your device and your personal iCloud account
• We do not collect, access, or have visibility into your aquarium data
• You are responsible for maintaining backups of your data
• We are not liable for any data loss, regardless of cause

8. iCloud and Apple Services

AquariumPulse uses Apple's iCloud service for data synchronization. Your use of iCloud is subject to:

• Apple's Terms and Conditions
• Your iCloud storage limits and availability
• Apple's policies and service availability

We are not responsible for:

• iCloud service interruptions or failures
• Data loss due to iCloud issues
• Conflicts with Apple's terms of service

9. In-App Purchases and Subscriptions

Premium Features

Some features of AquariumPulse may require payment through in-app purchases or subscriptions. By making a purchase, you agree to:

• Pay all applicable fees as described in the App
• Apple's terms for in-app purchases
• Our refund policy (handled through Apple)

Subscriptions

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel subscriptions in your Apple ID account settings
• Refunds are handled by Apple according to their policies

Price Changes

We reserve the right to change pricing at any time. Changes will not affect existing subscriptions until renewal.

10. Intellectual Property

All content, features, and functionality of AquariumPulse, including but not limited to:

• Software code and algorithms
• User interface design and graphics
• Text, images, and icons
• Trademarks and branding

Are owned by IMAD EL KHAFI and are protected by copyright, trademark, and other intellectual property laws.

11. User-Generated Content

Any photos, notes, or other content you create within the App:

• Remains your property
• Is stored locally on your device and iCloud
• Is not accessible to us or other users

If you choose to share content through the App's sharing features, you grant us a license to display that shared content only as necessary to provide the sharing functionality.

12. Updates and Modifications

App Updates

We may release updates to improve the App. You are responsible for keeping the App updated to the latest version.

Terms Updates

We reserve the right to modify these Terms of Use at any time. When we do:

• We'll update the "Last Updated" date
• Significant changes will be communicated through the App
• Continued use after changes constitutes acceptance

Service Changes

We reserve the right to:

• Modify or discontinue any feature of the App
• Change how the App functions
• Discontinue the App entirely with reasonable notice

13. Termination

By You

You may stop using the App at any time by deleting it from your device.

By Us

We may terminate or suspend your access to the App immediately if you:

• Violate these Terms of Use
• Use the App in a harmful or fraudulent manner
• Engage in prohibited activities

Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must delete the App from all your devices
• Your local data may be retained until you delete it

14. Third-Party Links and Services

The App may contain links to third-party websites or services. We are not responsible for:

• The content or practices of third-party sites
• Any damages resulting from third-party services
• The accuracy of information from external sources

15. Geographic Restrictions

AquariumPulse is available worldwide through the Apple App Store. However:

• Features may vary by region
• Some features may not be available in all countries
• You are responsible for compliance with local laws

16. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Morocco, without regard to its conflict of law provisions.

Arbitration

Any disputes arising from these terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law.

Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits.

17. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

No Agency

Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and us.
