By downloading, installing, or using MaxOut ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.
These Terms of Use constitute a legally binding agreement between you and the developer of MaxOut. The App is licensed, not sold, to you for use strictly in accordance with these terms.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions.
You may not copy, modify, distribute, sell, lease, sublicense, or reverse engineer any part of the App.
MaxOut is a strength training utility that provides one-rep max (1RM) calculations, strength standard rankings, plate loading calculations, warm-up set planning, rest timers, goal tracking, and progress charts. The App operates entirely offline and stores all user data locally on the device.
The App is intended for informational and educational purposes only. It is not a substitute for professional fitness coaching, medical advice, or certified personal training.
MaxOut offers optional premium features available through in-app purchases processed by the Apple App Store. The following purchase options may be available:
Important Subscription Information
Premium features may include, but are not limited to: ad-free experience, unlimited history and goal storage, relative strength score tracking, advanced analytics, premium share cards, CSV data export, and Apple Watch companion app functionality.
MaxOut may offer a free trial period for new subscribers. If a free trial is offered, you will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel at least 24 hours before the trial expires. Free trials are limited to one per Apple ID.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. All data you enter into the App is stored locally on your device. We do not collect, transmit, or store personal data on external servers.
The free version of MaxOut may display third-party advertisements. These ads are served by third-party ad networks and are subject to their respective terms and privacy policies. Premium subscribers receive an ad-free experience.
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
The 1RM calculations, strength standards, and rankings provided by the App are estimates based on mathematical formulas and published reference data. Actual performance may vary. You should always exercise caution and consult with qualified professionals before attempting maximal lifts.
To the maximum extent permitted by applicable law, in no event shall the developer of MaxOut be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, loss of data, or loss of profits, arising out of or in connection with your use of the App.
You acknowledge that strength training carries inherent risks of injury. You assume full responsibility for your training decisions and any physical activity you undertake based on information provided by the App.
All content, design, graphics, code, and features of the App are the intellectual property of the developer and are protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works based on the App without prior written consent.
We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
Upon termination, your license to use the App will immediately cease. Sections regarding disclaimers, limitation of liability, and intellectual property shall survive termination.
Your use of the App is also subject to Apple's standard End User License Agreement (EULA) available at Apple's Standard EULA. In the event of any conflict between these Terms and Apple's EULA, Apple's EULA shall prevail with respect to the provisions covered therein.
We reserve the right to modify these Terms of Use at any time. Changes will be posted on this page with an updated effective date. Your continued use of the App after any changes constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco, without regard to its conflict of law provisions.
